What is the Voice of McDonald's®  India?

It's our very first regional singing contest: showcasing the talents of our Crew and Managers, as we show society the kind of opportunities McDonald's provides for our restaurant employees. VOM looks to help integrate music into our day-to-day restaurant activities, Crew events, and recognition and incentive programs to help us energize our Crew and Managers in restaurants across the region through a common language - music.

This  competition is for McDonald's restaurant employees only (contestants must be  employed by McDonald's from date of entry submission through  2012).

Rules & Regulations

“Voice of McDonald’s” (VOM), our Worldwide Singing Competition for Crew and Managers, has become a key asset for our brand and the McDonald's® system. To maximize the execution of this global initiative, we, McDonald’s (North and East), i.e. M/s Connaught Plaza Restaurants Pvt. Ltd. (hereinafter referred to as “CPRPL” or “McDonald’s”) are organizing a local contest, identified as "VOM India”.

1. Contest Mechanics

Phase I (January-March)

Contest shall be launched on the Annual Communication Seminar on the 25th of January 2012. After the regional search for entries, a panel of external & internal judges as decided by McDonald’s shall judge on the basis of live auditions to be conducted in 3 centers – Delhi, Punjab & Kolkata. The auditions shall span over a day or two for each centre.

Phase II (April-June)

Shortlisted contestants from Phase 1 will be brought to Delhi for the next phase. Ten Semi-Finalists shall be selected from these live auditions by a judge’s panel. Once the semi-finalists are chosen, they have a 7-day preparation program that will guide them to the final event.

Phase III (July) (Final Phase)

After the week long preparation, the semi-finalists will perform live at the finale held at a venue decided by McDonald’s (to be disclosed closer to date) where the winners will be announced amidst fan-fare and following.

2. Eligibility

Each contestant must be continuously employed (including any valid leaves of absence) with McDonald's through 2012, (the "Contest Period") and be in good standing (beginning at the time of entry through the time the prize is awarded). By participating in the VOM Contest, each Contestant unconditionally accepts and agrees to comply with these VOM Official Rules and the decision of McDonald's, shall be final and binding in all respects. When determining whether an employee is in "good standing," McDonald's, in its sole discretion, may consider factors including, but not limited to, job performance and conduct. Participation in the Competition does not and will not constitute or may be deemed to constitute a guarantee of continued employment or employment for a specified term or to grant any rights to the Contestant.

3. Competition Details:

a.Each short listed Contestant must provide McDonald's with at least one (1) song choice that he/she wishes to perform at Phase 2 of the Competition. McDonald's may obtain/arrange the instrumental musical track or live band music (as determined by McDonald's in its sole discretion) for the songs specified by the Contestant only at 2nd and 3rd Phase of the Competition. If for any reason, the instrumental musical track or live band music for the Contestant's song choice cannot be obtained, Contestant must select an alternate song choice. McDonald's has the final discretion as to the choice of song to be performed by Contestant at the final Competition.

b.Subject to the limitations of paragraph 3(a )above, performance at the Competition can be in any language and any type/style of music and should not exceed any time limit set by McDonalds’ at its discretion at each phase.

c.Contestants are expected to attend all rehearsals at the times specified by McDonald's.

d.The semi-finalists will compete in the final round, which is scheduled to be held in the month of July,for the opportunity to be crowned VOM India 2012. McDonald’s will determine at random or via some other means of its sole choosing the order in which the Semi-Finalists will perform. All Contestants/ semi finalists may be required to participate in the group performance during the Final Competition as decided by McDonald’s.

e.The Contestants must at all times follow the instructions of McDonald's and the judges and must be present, according to the schedule provided, at the indicated place and time. Failure to follow such instructions and/or to be present at specified places/times in accordance with the provided schedule may result in disqualification.

f.McDonald’s reserves the right to automatically disqualify any Contestant if the performance at the competition includes any objectionable material or profanity (as determined by McDonald’s and/or the judges in their sole discretion), including but not limited to the attire/appearance/actions of the Contestant, or if performance is otherwise in violation of these competition rules or the official rules of the voice of McDonald’s singing contest for crew and managers, which are incorporated herein by reference. It is understood that the judges may stop the performance prior to completion. McDonald’s further reserves the right to disqualify a contestant if he/she behaves at any time during the contest period in a manner that McDonald’s or the judges determine in their sole discretion is illegal, anti-social, rude, threatening, violent/aggressive, disorderly, or otherwise inappropriate. Should a Contestant be disqualified at any Phase pursuant to this paragraph, he/she may be required to forfeit any prize won without compensation of any kind.

g.All dates/times are subject to change at the sole discretion of McDonald's.

h.Incomplete/unsigned applications or late entries shall not be considered for participation.

i.Participation in the contest shall imply unconditional and full acceptance of all the above terms and conditions of the competition.

j.In case of any dispute or difference in respect of the contest/competition, the decision of McDonald’s shall be final and binding on all concerned.

4. Judging

The panel of judges for the Competition will consist of judges with expertise in the music/talent discipline. The decisions of the judges are final and binding in all judging matters relating to this Contest. All scoring shall at all times remain confidential and shall not be disclosed. Performances at the Competition will be judged on the following criteria: singing ability (including range, tone, rhythm, etc.) (60%), creativity (20%), and on-stage presence (20%). In case of a tie, entries will be re-judged based solely on the criterion of singing ability and the final decision to be taken by the panel of judges at their sole discretion.

5. Rights

By participating in the Competition, each Contestant consents to McDonald's filming, taping and/or making an audio and video recording of his/her performances in the Competition for use for advertising, trade, publicity and promotional purposes at its sole discretion, without compensation (other than the Final Competition prize as decided by the Judges and McDonald’s). Contestant further agrees to cooperate fully with McDonald's in such recording activities. Each Contestant agrees to execute all documents and take all actions deemed necessary by McDonald's to affect record or perfect such assignment. Each Contestant expressly disclaims any and all ownership rights in the Performances and acknowledge and agree that McDonald's has an unrestricted right to use the Performances (or materials or ideas similar to the Performances) in any manner in any medium presently known or hereafter devised, now and in the future, without notice, additional compensation (other than the Final Competition prize as decided by McDonald’s) or other obligation. Each Contestant acknowledges that McDonald's may use the Performances in any medium in any manner without territory or time restrictions. Such use may include, but is not limited to, exhibition on broadcast television or the Internet, with or without attribution to the Semi-Finalist or other comment/commentary, as determined by McDonald's in its sole discretion. Nothing herein in any way obligates McDonald's to use the Performances and, such non-use will not result in any liability to McDonald's.

6. Prize Information:

Winner: `50,000 First Runner Up: `25,000 Second Runner Up: `15,000 Remaining Finalists: `7,500

7. Background Checks:

If McDonald's so elects, Contestant may be required to submit to a confidential background check conducted by McDonald's to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Contest will not bring McDonald's into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest as determined by McDonald's.

8. General Conditions of Participation:

Acceptance of prize, constitutes permission of the Contestant to use his/her name, photograph, likeness, voice and biographical information, for advertising/trade/promotional/publicity purposes, and any and all rights to said use, without further notice or compensation or authorization, except where prohibited by law. Contestant, if applicable, agrees that McDonald's shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Contest or from acceptance, receipt, possession and/or use or misuse of prizes in the Contest.

9. Miscellaneous:

• Disqualification:

It is the Contestant's responsibility to ensure that he/she has complied with the conditions contained in these Competition Rules. McDonald's reserves the right in its sole discretion to disqualify any Contestant who is found to be tampering with the operation of the Contest; to be acting in violation of these Competition rules; or to be acting in bad faith or in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation and/or purpose of the Contest, or to annoy, abuse, threaten or harass any other person. McDonald's reserves the right to seek damages and other remedies from any such Contestant/person to the fullest extent permitted by law.

• Force Majeure:

Subject to any governmental approval which may be required, McDonald's reserves the right, without prior notice and at any time, to terminate the Contest, in whole or in part, or modify or suspend the Contest in any way, if it determines, in its sole discretion, that the Contest is impaired or corrupted or that fraud or technical problems, failures or malfunctions have destroyed or severely undermined the proper play, integrity, and/or feasibility of the Contest. In the event McDonald's is prevented from continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or manmade epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within McDonald's control (each a "Force Majeure" event or occurrence), McDonald's shall have the right to modify, suspend, or terminate the Contest.

• Effect on other contest materials and rules:

To the extent there any discrepancies or inconsistencies between the other Contest materials and these Competition Rules, these Competition Rules shall prevail, govern and control. To the extent there are any discrepancies or inconsistencies between disclosures or other statements contained in any other Contest materials and the terms and conditions of these Competition Rules, these Competition Rules shall prevail, govern and control. These Competition Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of McDonald's. The invalidity or unenforceability of any provision of these Competition Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Competition Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
